How is vacation pay calculated under the Annual Leave Act?
Vacation pay is calculated under the same-pay rule (fixed salary) or the percentage rule (variable or varied employment). Same-pay rule: monthly salary + 0.43% per vacation day. Percentage rule: 12% of pay during the qualifying year.
1. Same-pay rule for monthly/weekly salaryAnnual Leave Act s. 16a
If the employee has a fixed weekly or monthly salary, vacation pay is calculated under the same-pay rule. It consists of the current salary at the time of leave plus a vacation supplement of 0.43% of the monthly salary per paid vacation day (or 1.82% of the weekly salary).
2. Percentage rule for variable pay or varied employmentAnnual Leave Act s. 16
If the employee has variable pay or a varying level of employment, the percentage rule applies. Vacation pay is then 12% of the vacation-qualifying pay during the qualifying year.
3. What counts towards the pay base under the percentage ruleAnnual Leave Act s. 16b
Vacation pay and compensation for vacation-qualifying absence are not included in the pay base. For vacation-qualifying absence days, a standard amount equal to ordinary pay is added instead.
